Pursuant to the state open records law, Ariz. Rev. Stat. Ann. Secs. 39-121 to 39-122 and 39-128, I hereby request the following records:

Any and all mug shots taken between the days of Jan. 1, 1960 and Jan. 1, 2014.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I would request your response within ten (10) business days.

Eric,

We received your request for inmate photos. I would like to let you know that photos taken between 1985 and the present are available to the public on the ADC website. I have included a link to the inmate data search tool for your convenience: http://www.azcorrections.gov/Inmate_DataSearch/Index_Minh.aspx

Photos older than 1985, however, were not stored digitally. It would not be possible to compile these older photos for this request.

Hi,

We require a bulk set of data to process on our own systems. The inmate data search tool requires that we know the last name, gender, and current status before searching. Mugshots with dates are required for our base level graphs but information on the crimes themselves (location, type, etc.) would also help us provide more information like crime maps over time with filtering based on type.

We feel that compiling this information into aggregate statistics is in the public interest. Thank you for any assistance you are able to provide us.

Eric,

The photos you are requesting are available on the website. A report with all these photos and corresponding information does not exist.

The best, and only option for such a large request is to review the ADC website for inmate photos. If you discover a photo is missing, I will be happy to search for a specific photo and have it placed on the website if a photo is available.

Hi,

As I stated before the inmate data search tool requires that we know the last name, gender, and current status before searching. This information is not currently available in any form so gathering aggregate statistics is not possible.

The data definitely exists because it is powering the search tool but the access is being limited to that tool for unknown reasons. We believe our access to crime/incarceration data is within the public interest.

In regards to the searchable database of mug shots currently on the ADC website, all available mug shots and the information about the inmate's ADC history are on the website for viewing by the public. Public records law does not require the ADC to develop a new method for searching an already-existing database that is free and open to public inspection at any time.
