Pursuant to the state open records law, Ariz. Rev. Stat. Ann. Secs. 39-121 to 39-122 and 39-128, I hereby request the following records:

- Number of times information uploaded to the Arizona Counter Terrorism Information Center's intelligence databases had to be corrected or removed because they wer erroneous or deficient, or because the source agency did not have authority to gather or share the information.

- Breakdown of number of suspicious incident reports, suspicious activity reports, and field interview reports in Arizona Counter Terrorism Information Center's intelligence databases.

- Number and list of all public agencies and/or private contractors providing services of any kind to Arizona Counter Terrorism Information Center.

- Breakdown of the number of tips and leads in the Arizona Counter Terrorism Information Center's intelligence databases acquired via intelligence information or email, phone, internet or incident report submission.

- Number of tips and leads in Arizona Counter Terrorism Information Center's intelligence databases acquired from cellphone tower dumps, cell site simulators (commonly known as "Stingrays"), and surveillance cameras.

- A copy of all contracts signed by the Arizona Counter Terrorism Information Center.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

This is a public records request for a list of any and all processing notes and search slips relating to record request #2015-0094, as well as a list of which material requested was redacted and the exemption associated with each redaction.

Public records, as defined by Arizona statute, include documentary materials made or received by an governmental agency in pursuance of law or in connection with the transaction of public business, which includes processing notes and search slips related to a record request. If this is a request denial, please send the relevant statute and exemption number which you believe makes a distinction between "information" and "documents."

P.S., please refer to case law, including Shapiro v. U.S. Dept. of Justice, which indicates that various documents created while processing public records requests, including search slips, processing notes, and case evaluation forms, are documents.

Arizona Revised Statute 39-121 states that "Arizona Public records and other matters in the custody of any officer shall be open to inspection by any person at all times during office hours."

39-121.01 also clearly states, in pertinent part, that “the custodian of the records of an agency shall…furnish an index of records or categories of records that have been withheld and the reasons the records or categories of records have been withheld from the requesting person.”

Nowhere does ARS 39-121.03 Number 2 state that DPS is exempt from listing redacted materials from public records request, or is unable to furnish processing notes.

Please provide me with a written estimate for the fulfillment of this request.

As mentioned, processing notes are defined as the various documents created while processing public records requests, including search slips, notes, case evaluation forms, emails, and other documents.
