This correspondence is in response to a request for inspection or copies of
public records. Your request has been evaluated in accordance with the
Maryland Public Information Act, Annotated Code of Maryland, General
Provisions Article § 4-101, et seq. (MPIA). You have requested a copy of
records pertaining to Differential Treatment and Conduct Unbecoming reports.

Pursuant to § 4-203(b)(2) of the MPIA, I reasonably expect that it will
take more than 10 working days to produce responsive records. The reason
for this delay is that, due to the current COVID-19 situation, the
Department’s Central Records is closed to the public and we are therefore
backlogged more than usual.Furthermore, I will need to coordinate locating
and reviewing potentially responsive records with another component of the
Department. Your request is being processed and response will be
forthcoming within the required 30 days.

This correspondence is in response to the request for inspection or copies
of public records below. Your request has been evaluated in accordance
with the Maryland Public Information Act, Annotated Code of Maryland,
General Provisions Article § 4-101, et seq. (MPIA). Specifically you have
requested records pertaining to internal complaints of 2019.

Upon search, there were five internal complaints filed for differential
treatment and three complaints filed for conduct unbecoming. Regarding your
request for the actual reports, they would have been created during the
course of an investigation conducted by the Department’s Internal Affairs
Section. This would be considered part of an investigation of employee
misconduct, which is deemed a personnel record. Such records are
mandatorily exempt from disclosure under the MPIA because they are
personnel records of an individual (MPIA § 4-311). See also Montgomery
County v. Shropshire, 420 Md. 362, 381 (2011) and Baltimore City Police v.
State, 158 Md. App. 274, 282-283 (2004). In accordance with the provisions
cited, this portion of your request is denied.

You may challenge any part of this response to your request by filing an
action in the appropriate court of law pursuant to MPIA § 4-362.
