Pursuant to the New Mexico Inspection of Public Records Act, I hereby request the following records:

Documents, including but not limited to emails, memos, and incident reports, mentioning or describing any reported or encountered incidents of "ransomware," which may be loosely defined as a type of malware that threatens to permanently encrypt and/or unless a ransom is paid.

I am a member of the news media and request classification as such. I have previously written about the government and its activities, with some reaching over 100,000 readers in outlets such as Gizmodo, MuckRock, Motherboard, Property of the People, Unicorn Riot, and The Outline, among others. As such, as I have a reasonable expectation of publication and my editorial and writing skills are well established. In addition, I discuss and comment on the files online and make them available through non-profits such as the library Internet Archive and the journalist non-profit MuckRock, disseminating them to a large audience. While my research is not limited to this, a great deal of it, including this, focuses on the activities and attitudes of the government itself. As such, it is not necessary for me to demonstrate the relevance of this particular subject in advance.

As my primary purpose is to inform about government activities by reporting on it and making the raw data available, I request that fees be waived.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 15 business days, as the statute requires.

The CAD provides information of when the call was received, when and what officers were dispatched, and a description of what happens throughout the incident. In addition, please keep in mind a 5 minute lapel video can take up to 20 minutes to review depending on the type of redactions that are necessary to complete. Please contact my office should you wish to set up an inspection. There is no cost to inspect the records in person. If you are unable or unwilling to inspect in person, or if you would prefer copies of the non-exempt responsive records – then under the law the City “may require advance payment of the fees before making copies of public records.” NMSA 1978, § 14-2-9(C)(5). Prior to copying and mailing the records, my office will require advance payment of the copying fees ($0.50 per page) as well as the costs associated with mailing the set of documents to you. See NMSA 1978, § 14-2-9(C)(4) (“may charge the actual costs associated with transmitting copies of public records by mail”). 

 

We have determined there are 6900 responsive documents with an estimated 3 pages per document (some may be larger and some smaller) totaling 20,700 pages at a cost of $0.50 per page for a total estimated cost of $10,350.00 and we will require advance payment of $5,175.00 (50%) for the copying and mailing costs. An invoice for those costs has been provided for your convenience. Should you desire the copies then my office will mail those records after we have received payment.
