To Whom It May Concern:

Pursuant to the New Mexico Inspection of Public Records Act, I hereby request the following records:

A. Copies of emailed Google Alert subscription confirmations received between January 1, 2016 and the date of the processing of this request.

B. Copies of all emailed Google Alerts received between January 1, 2016 and the date of the processing of this request. Google Alerts may be identified by any or all of the following:

1. Containing the phrase "Google Alert" in the Subject line
2. Being sent by an email address with the display name "Google Alerts"
3. Being sent from the email address googlealerts-noreply@google.com

I am a member of the news media and request classification as such. I have previously written about the government and its activities, with some reaching over 100,000 readers in outlets such as Gizmodo, MuckRock, Motherboard, Property of the People, Unicorn Riot, and The Outline, among others. As such, as I have a reasonable expectation of publication and my editorial and writing skills are well established. In addition, I discuss and comment on the files online and make them available through non-profits such as the library Internet Archive and the journalist non-profit MuckRock, disseminating them to a large audience. While my research is not limited to this, a great deal of it, including this, focuses on the activities and attitudes of the government itself. As such, it is not necessary for me to demonstrate the relevance of this particular subject in advance.

As my primary purpose is to inform about government activities by reporting on it and making the raw data available, I request that fees be waived.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 15 business days, as the statute requires.

Although we are acknowledging this request by this correspondence, we have determined your request is “excessively burdensome” and my office respectfully requests an “additional reasonable period of time” to complete the request. NMSA 1978, § 14-2-10.  We have deemed your request “excessively burdensome” because at this time various City offices are closed or functioning at limited capacity.  We are working to fulfill requests where possible and may be able to fulfill your request sooner.  However, some requests may take 45-60 days.

We will be placing any responsive emails on a CD in batches, based on the number of responsive emails, we are requiring you to mail us $6.75 to cover the cost of the first CD for the first batch of emails. Under IPRA, the Custodian may request a deposit.

All government entities “may require advance payment of the fees before making copies of public records.” NMSA 1978, § 14-2-9(5) The right of “advance payment” functions to ensure that government resources (e.g. copying and mailing costs) are not needlessly expended without compensation while attempting to satisfy IPRA requests.  We will require advance payment for your public records request. Once the check is received and processed, then I will contact you and provide you further details in order to finalize the remainder of your request. If we need to use more than one CD, we will notify you and provide a new invoice.

 

 

At this time City buildings are closed to the public due to COVID-19. If you are seeking to inspect the reports at our office, the inspection will take place once we have resumed our normal business practices. We have suspended free inspections pursuant to the guidance of the Attorney General. However, we are waiving shipping costs.

 

Please see the invoice that was released to you via NextRequest for the mailing address. Once our review is complete and we receive your payment, we will mail the first CD to you.

I am following up with you regarding your Inspection of Public Records Act (“IPRA”) request submitted on July 29, 2020 (identified as #20-5208). On December 16, 2020 and again on December 21, 2020, my office notified you that we have certain non-exempt responsive records and that a deposit is necessary prior to continuation of the process.

 

To this date, you have not responded to our multiple requests for the deposit. It appears that you no longer desire these records. If that is the case then please send my office a written communication through Next Request #20-5208 and indicate that you no longer wish these records and you also wish to have this request closed. If you are no longer interested in reviewing the public records, then we hope you are willing to extend that courtesy.

 

Please respond to my office within two (2) days of this communication. If you have not inspected the records nor responded to this communication within that timeframe, my office will close your request to focus its limited resources on preparing records for requesters who still wish to inspect them. In that event, we will continue our production of records after a new request to inspect them is made.
