To Whom It May Concern:

Pursuant to the New Mexico Inspection of Public Records Act, I hereby request the following records:

Copies of any emails, letters, memos or other records of consultations regarding public records requests (FOI/FOIL/FOIA etc.) with either the Department of Justice, including the Federal Bureau of Investigation and Drug Enforcement Agency components.

I am a member of the news media and request classification as such. I have previously written about the government and its activities, with some reaching over 100,000 readers in outlets such as Gizmodo, MuckRock, Motherboard, Property of the People, Unicorn Riot, and The Outline, among others. As such, as I have a reasonable expectation of publication and my editorial and writing skills are well established. In addition, I discuss and comment on the files online and make them available through non-profits such as the library Internet Archive and the journalist non-profit MuckRock, disseminating them to a large audience. While my research is not limited to this, a great deal of it, including this, focuses on the activities and attitudes of the government itself. As such, it is not necessary for me to demonstrate the relevance of this particular subject in advance.

As my primary purpose is to inform about government activities by reporting on it and making the raw data available, I request that fees be waived.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

I am following up with you regarding your Inspection of Public Records Act (“IPRA”) request submitted on September 17, 2019 (identified as # 19-6230).

 

It appears that you no longer desire to inspect these records. If that is the case then please send my office a written communication through Next Request #19-6230 and indicate that you no longer wish to inspect these records and you also wish to have this request closed. If you are no longer interested in reviewing the public records, then we hope you are willing to extend that courtesy.

 

Please contact my office should you wish to set up an inspection. There is no cost to inspect the records in person. If you are unable or unwilling to inspect in person, or if you would prefer copies of the non-exempt responsive records – then under the law the City “may require advance payment of the fees before making copies of public records.” NMSA 1978, § 14-2-9(C)(5). Prior to copying and mailing the records, my office will require advance payment of the copying fees ($0.50 per page) as well as the costs associated with mailing the set of documents to you. See NMSA 1978, § 14-2-9(C)(4) (“may charge the actual costs associated with transmitting copies of public records by mail”). 

 

Please respond to my office within two (2) days of this communication. If you do not response to this communication within that time and if you fail to come in to inspect the records within the next two (2) days then my office will be forced to close out your request. Even though your inactions may force my office to close this request, you are always welcome to resubmit a new request in the future. We hope you understand the predicament your inactions have placed us, we only have a finite amount of time and resources and it would be a disservice to the Citizens of Albuquerque to spend it on a request where the requester has failed to response to our communications and also failed to inspect the records made available.
