Any documents and communications regarding any steps the district took to verify the implementation of the recommendations, guidelines, best practices, procedures, mandates and/or requirements issued by the CDC, or NYS Health Department, or any other regulatory body, did not violate any of the following laws:

Any documents and communications regarding any steps the district took to verify the FDA Approved vaccine Comirnaty, was being administered, as advertised, at district funded and/or promoted events.

Any documents and communications regarding any steps the district took to verify the available EUA Vaccine was interchangeable with the unavailable FDA Approved vaccine Comirnaty.

Any documents and communications regarding any steps the district took to verify the legality of mandating the EUA vaccine for 5-11 year olds.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Dear Superintendent of Schools,

I am writing to appeal the effective denial of my Freedom of Information Law (FOIL) request submitted to the City School District of Albany on February 17, 2022. The request sought documents and communications regarding the district's steps to verify the implementation of various recommendations, guidelines, best practices, procedures, mandates, and/or requirements issued by the CDC, NYS Health Department, or any other regulatory body, and did not violate certain laws.

The district acknowledged receipt of my request on February 25, 2022, and stated that a search for records would be conducted, with a further response anticipated within 20 business days. However, despite numerous follow-up attempts on my part, I have not received any further communication from the district regarding the status of my request.

Under Section 89(3)(a) of the New York Public Officers Law, an agency has five business days to grant or deny access to records in whole or in part, or if more time is needed, to acknowledge the receipt of a request in writing and provide a date by which the agency will make the record available, deny the request, or furnish a written reason for a further delay. As of the date of this letter, it has been well beyond the statutory timeline, and I have not received any of these responses.

I am appealing this effective denial on the grounds that the district has failed to respond within the statutory timeline. I kindly request that you review this appeal and provide a determination as soon as possible.
