Pursuant to the New York Freedom of Information Law, I hereby request the following records:

Any documents and communications regarding any steps the district took to verify the implementation of the recommendations, guidelines, best practices, procedures, mandates and/or requirements issued by the CDC, or NYS Health Department, or any other regulatory body, did not violate any of the following laws:

Any documents and communications regarding any steps the district took to verify the FDA Approved vaccine Comirnaty, was being administered, as advertised, at district funded and/or promoted events.

Any documents and communications regarding any steps the district took to verify the available EUA Vaccine was interchangeable with the unavailable FDA Approved vaccine Comirnaty.

Any documents and communications regarding any steps the district took to verify the legality of mandating the EUA vaccine for 5-11 year olds.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Subject: Appeal for NYS FOIL Request – Legality and Safety (City School District of Albany)

To Whom It May Concern:

I am writing to appeal the non-responsive status of my New York Freedom of Information Law (FOIL) request dated February 17, 2022, regarding the City School District of Albany's compliance with various laws, regulations, and guidelines related to the implementation of COVID-19 health and safety measures.

Despite multiple follow-up emails, I have not received any substantive response or acknowledgment from your office. Pursuant to New York's Freedom of Information Law, public authorities are required to respond to FOIL requests within five business days, either by providing the requested information, denying the request, or providing a written acknowledgment of receipt with an estimated time for a full response. As of today, it has been more than 14 months since I submitted my request, and I have not received any of these required responses.

The information sought is of significant public interest, as it pertains to the City School District of Albany's adherence to various laws, regulations, and guidelines during the COVID-19 pandemic. The general public has a right to know how these guidelines were implemented and whether the district took the necessary steps to ensure the safety and legal rights of its students and staff.

I kindly request that you expedite the processing of my FOIL request and provide the requested information as soon as possible. If you determine that some or all of the requested information is exempt from disclosure, please provide a detailed explanation for the exemption, as required by law. Furthermore, if you determine that providing the requested information would entail fees, kindly inform me of the total charges in advance of fulfilling my request.
