Pursuant to the New York State Freedom of Information Law (1977 N.Y. Laws ch. 933), I hereby request the following records:

The written agreement or Memorandum of Understanding between the City of Albany and the University at Albany for law enforcement purposes in accordance with N.Y. EDUC. LAW § 355 (2) (l).

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

A request had been made, and fulfilled June 27, 2013. However, a new request is being made because since that time the City of Albany Police Chief has changed and also the University at Albany seems to have inexplicably reverted to using a Memorandum of Understanding that had become active in January 1, 1999 http://www.albany.edu/ehs/pdf/UAlbanyEmergencyManagementPlan.pdf (pages 153-154) (Archived by WebCite® at http://www.webcitation.org/6fh8P20Fv ) which would have been signed by a different University at Albany President, different City of Albany Mayor, and different City of Albany Police Chief than the present ones. In current University at Albany President Jones' Letter of Promulgation contained within the 2015 Emergency Management Plan, he stated, "this Plan is a Guide to the University for Emergency Management and coordination of all phases of emergency management operations, in order to minimize the impact of emergencies and disasters, and to protect the people, property, and restore the ability of the University to serve our mission." How exactly a plan with a Memorandum of Understanding from seventeen years ago likely to serve the university or the city well, I'm not sure, particularly if the City of Albany is relying on the 2008 one, or some other one.

If my request is too broad or does not reasonably describe the records, please contact me via email so that I may clarify my request, and when appropriate inform me of the manner in which records are filed, retrieved or generated.

If for any reason any portion of my request is denied, please inform me of the reasons for the denial in writing and provide the name, address and email address of the person or body to whom an appeal should be directed.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

LAW § 355 (2) (l) [lowercase L], in relevant part: "Subject to the approval of the chancellor, the president of each state-operated campus of the state university shall enter into a written agreement with adjoining law enforcement agencies establishing protocols for the exercise of authority by such university police officer off-campus, including mutual aid and assistance. Such written protocols shall not be deemed to supersede the authority of other police officers."
