This is a request for records under your state public records law. I am requesting copies of public records regarding health and behavioural health service delivery in youth correctional facilities in your jurisdiction, to inform a comparative research project regarding health and mental health care delivery in juvenile detention facilities across the US. Specifically, I request information regarding the following:
1. Name and contact details for those responsible for health and behavioural health services provisions at all locations where juveniles are incarcerated within your jurisdiction.
2. Regulations, policies and procedures that govern the operation of health and behavioral health provision for juveniles incarcerated within your jurisdiction. This includes health intake, room confinement, medication management, access to specialist and dental services, discharge planning services, and other health and behavioral health related policies.
3. Contracts from January 1, 2021 to the time the request is filled between your agency and any healthcare provider including both physical health and behavioral health.
4. Records concerning your jurisdiction’s most recent application to Centre for Medicaid Services (CMS) for an 1115 Medicaid waiver (if applicable), and any response, with specifically focus on how and whether such a waiver applies to provision of Medicaid funded services for detained juveniles.
5. Records relating to financing for health and behavioural health care delivery in your jurisdiction.

I request the records be provided electronically. If there are any fees for searching or copying these records, please inform me. However, I would also like to request a waiver of all fees in that the disclosure of the requested information is in the public interest and will contribute significantly to the public’s understanding of the administration of juvenile justice. This information is not being sought for commercial purposes.

If access to the records I am requesting will take longer than allowed by statute, please contact me with information about when I might expect copies of the requested records.

7 AAC 52.025. Physical examination. <https://www.akleg.gov/basis/aac.asp#7.52.025> Medical personnel shall give each new resident of a facility a complete physical examination within seven days after admission.
7 AAC 52.100. Health services. <https://www.akleg.gov/basis/aac.asp#7.52.100> (a) The superintendent of a facility shall ensure that adequate medical and dental services are provided to all residents. (b) The facility physician shall supervise the prescription and administration of medication. The physician may designate appropriate staff members to assist the physician. Medication may be prescribed only by licensed physicians or other health professional authorized under state law to prescribe medications. The superintendent shall devise procedures to prevent access by residents to medications and medical reports. (c) Pre-release medical examinations may be provided.
7 AAC 52.135. Training of youth counselors. <https://www.akleg.gov/basis/aac.asp#7.52.135> (a) Each youth counselor shall undertake 120 hours of training during the first year of employment and an additional 40 hours each subsequent year of employment. The training shall be provided by the division in the subjects listed in (b) of this section. (b) The subjects of the required training are as follows: (1) security procedures; (2) supervision of juveniles; (3) signs of suicide risks, and suicide prevention; (4) medication distribution and pharmacology effects; (5) restraint techniques, use-of-force regulations, and tactics; (6) report writing; (7) department regulations; (8) rights and responsibilities of juveniles; (9) fire and emergency procedures; (10) safety procedures; (11) key control; (12) interpersonal relations; (13) social/cultural lifestyles of the juvenile population; (14) communication skills; (15) first aid, including cardiopulmonary resuscitation (CPR); (16) counseling techniques.
7 AAC 52.200. Treatment team. <https://www.akleg.gov/basis/aac.asp#7.52.200> The superintendent shall establish a committee of at least three persons composed of available qualified personnel to serve as the treatment team. This team shall assign a counselor to the juvenile, periodically review the juvenile's progress and make recommendations, review and update treatment planning, and prepare and implement release planning subject to approval of the review board and the superintendent. The treatment team shall consider recommendations, if any, made by the assigned probation officer.
7 AAC 52.415. Health inspection upon admission. <https://www.akleg.gov/basis/aac.asp#7.52.415> (a) A juvenile detention facility shall provide for the safekeeping, housing, care, and subsistence of those juveniles admitted 7 AAC 52.400<https://www.akleg.gov/basis/aac.asp#7.52.400>. However, if the admitting facility staff member finds the juvenile to be unconscious or in immediate need of medical attention, the admitting staff member shall advise the remanding or admitting party to contact responsible medical authority. The admission process may not be commenced until the admitting staff member is satisfied that the admittee has received medical attention. (b) During the admission process, the admitting staff member shall determine whether the admittee is in need of any medical attention by inspecting for obvious injuries or illnesses, and by inquiring about any medical problems or recent use of medication or unprescribed drugs. Juveniles who appear to be ill, injured, or incapacitated by alcohol, narcotics, or similar agents, but not in immediate need of medical attention, must be given medical attention as soon as practical. A written record must be kept of the admission interview and health inspection.
7 AAC 52.450. Secure confinement. <https://www.akleg.gov/basis/aac.asp#7.52.450> (a) When a juvenile's behavior necessitates placement in secure confinement for the safety of the juvenile or others, or to ensure the security of the facility, the juvenile may be so confined for a period of up to 24 hours. Secure confinement for periods of more than 24 hours must be reviewed every 24 hours by the superintendent or the superintendent's designee who was not involved in the incident necessitating that confinement. Secure confinement may be extended for additional periods if necessary for the safety of juveniles or others, or to ensure the safety of the facility. Secure confinement may not exceed five 24-hour periods. (b) A facility shall provide appropriate services and programs for high-risk juveniles who cannot control their assaultive behavior, who present a danger to themselves, or who are in constant danger of being victimized by other juveniles, thus requiring special management. The facility may, if the facility determines that it necessary, separate such juveniles from the general population to allow for individualized attention.

3. Contracts from January 1, 2021 to the time the request is filled between your agency and any healthcare provider including both physical health and behavioral health.
DJJ has 10 healthcare contracts covering six facilities.

4. Records concerning your jurisdiction’s most recent application to Centre for Medicaid Services (CMS) for an 1115 Medicaid waiver (if applicable), and any response, with specifically focus on how and whether such a waiver applies to provision of Medicaid funded services for detained juveniles.
Alaska’s 1115 Renewal Application and signed application letter to CMS are attached and can also be found at https://health.alaska.gov/dbh/Pages/default.aspx, along with additional information. Alaska is not currently utilizing Medicaid funded services for detained juveniles while they are within a DJJ facility.

5. Records relating to financing for health and behavioural health care delivery in your jurisdiction.
DJJ healthcare appropriation is funded at $1,488,600. In 2018, DJJ was awarded a federal mental health grant in the amount of $1,437,951. This grant closes in 09/2023 and to date DJJ has expended $1,230,989.08. DJJ intends to spend the remaining funds before the grant closes.
