Pursuant to the Alaska Public Records Act, I hereby request the following records:

-The current memorandum of agreement (MOA) or memorandum of understanding (MOU) with the Defense Logistics Agency, Disposition Services regarding the 1033 equipment surplus program administered by the DLA Law Enforcement Support Office

-The annual inventory form required to be completed by MSP by the state coordinator of the 1033 program

According to the DLA FAQ page regarding the 1033 program, yours is the agency in charge of coordinating the 1033 program for the state. See http://www.dispositionservices.dla.mil/leso/Pages/StateCoordinatorList.aspx

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

This is a request for the full 1033 equipment transfer data to the agency level for all transfers -- more than a dozen state coordinators have released their state property book spreadsheet without any redaction. See, for instance, the attached spreadsheets released by the state coordinators in Ohio, Arizona and Iowa.

Please send the corresponding spreadsheet for Alaska.

To be clear, my request is for the full agency-by-agency inventory spreadsheet as released by more than 25 state coordinators of the 1033 program. The spreadsheet released by your office on August 21 does not include agency information for all transfers. As such, I do not consider my request fulfilled.

If the above constitutes your final response to my request, I consider my request to have been unduly rejected, particularly since your office did not provide any legal justification under the Alaska public records statute for withholding agency information for particular transfers. Please confirm whether this is the case, as well as the appropriate appeals authority to which I ought to appeal this determination, as appropriate.

A number of the above departments are not accounted for in the spreadsheet you've provided that breaks down equipment by agency. Furthermore, the county-by-county portion of the spreadsheet indicates that agencies in the following counties received tactical equipment:

Everyone,
The inventory sheets sent to you were prepared by the Defense Logistics Agency and they would be best to inquire as to how the list is compiled and where they conduct the actual physical inventory count.

I do not have access to the complete wide inventory at this time since DLA is not recognizing me as an authenticated user based on a security issue between DPS and LESO. This is a computer glitch that has not been resolved to date.

Please advise as to whether you have provided me with the comprehensive documentation of the August LESO audit, and in particular whether all departments with 1033 equipment are included in the documents provided.
