To Whom It May Concern:

Pursuant to the Alabama Public Records , I hereby request the following records:

Under the Alabama open records law 36-12-40 et seq. I am requesting the opportunity to obtain copies of public records that will help me elucidate the timeline for when Kevin Robert Macaluso interviewed, was offered the position, and accepted the position as Chair of the microbiology and immunology dept at the University of South Alabama. As I realize as of 8/1/2019, Kevin Robert Macaluso became a resident of Alabama, the lawsuit this information is needed for began in early 2019, well before he relocated to Alabama. Additionally, I have requested these items in discovery and he is not complying with the law.

If there are any fees for searching or copying these records please inform me if the cost will exceed $25. However I would like to request a waiver of all fees. This information is not being sought in commercial purposes. The statute requires a response in a reasonable time period. if access to the records I am requesting will take longer please contact me with information about when I might expect copies or the ability to insect the requested records. If you deny any and all of this request please cite each specific exemption you feel justifies the refusal to release the information and notify me of the appeal procedures available to me under the law.

From:

Ms. Davis -

The attached letter of January 28, 2020 has been forwarded to my office for
response. As you have been informed several times in the past, the Attorney
General of Alabama has opined that the open records laws of this state are
for the benefit of Alabama citizens. I have sent you a copy of that
opinion, but can send another copy upon request.

Your previous requests have indicated that you live in Louisiana, while you
state in your January 28 correspondence that you are a citizen of Alabama.
Please send me documentation of your Alabama residency, such as a deed or
lease, Alabama drivers license, or utility bill showing residence in the
state.

Please also be aware that the information requested can be obtained
pursuant to a subpoena issued through the courts of Alabama.
