But the impact could be huge.\r\n\r\nAs biometric technologies have advanced — with fingerprint scanners now standard on many phones and DNA testing becoming [a consumer industry](http://integenx.com/products/rapid-dna/) — private companies have become increasingly aggressive about selling these services to law enforcement groups. And just as technology that powers your cell phone has shrunk in both size and cost, mobile surveillance and tracking tools are now being deployed more cheaply than ever before — and with less oversight.\r\n\r\nThere is no existing national database that tracks who is using what, how well its working, or what policies are in place to understand how your freedoms are being protected. So MuckRock and the EFF are doing a national census — via public records requests — asking agencies what they have and how they're using it.\r\n\r\nOnce you fill out the form below, we'll take the information and generate a legally-binding public records request, customized to the jurisdiction you're interested in ([an example of what the public records request will look like](https://www.muckrock.com/foi/boston-3/mobile-biometric-technologies-20099/)).\r\n\r\nTogether, we can map how these technologies are being used — and potentially abused — across the country.             "description": "Project SpyLighter launched unofficially with the September 16, 2013 responsive documents on a FOIA of <A href=\"https://www.muckrock.com/foi/united-states-of-america-10/vupen-contracts-with-nsa-6593/\">Vupen&apos;s contract with the NSA.</a> \r\n\r\nIt has since coalesced around the core ideas of surveying technology\r\nin use by the NSA and other agencies, confirming the identities of\r\ncorporations contracting with these agencies, and revealing how much\r\nmoney they actually spend on private contracts. We intend to FOIA the\r\nNSA and other agencies for their contracts with any companies which either manufacture and sell spy\r\ntechnology to U.S. intelligence agencies, or companies which are forced\r\nto install and use this technology on behalf of the spy agencies.\r\n\r\nAll of the documents posted are legally obtained through the FOIA process. \r\n\r\n\r\n\r\n<p><b>Who's behind this project?</b></p>\r\n<p>\r\n<A href=\"https://www.twitter.com/abbynormative\">Heather Akers-Healy</a> is an activist and researcher based in California.  She has a background in legal research and anthropology and is learning how to code. Her interests include civil rights, freedom of information, privacy, and examining how technology influences culture.<br>\r\n<A href=\"https://www.twitter.com/ramdac\">Jason Gulledge</a> is a systems architect, programmer and researcher living in Paris, France. \r\nHe is focused on fighting censorship, defending press freedoms, and fighting for personal privacy.  \r\n</p>\r\n\r\n<p><b>Other Contributors</b></p>\r\n\r\n\r\n<p>Runa Sandvik is privacy and security researcher and sometimes Forbes\r\ncontributor.</p>\r\n\r\n<p>Scott Ainslie is an undergraduate. He is a Fellow of Free Software\r\nFoundation Europe and harbours a specific interest in privacy-enhancing\r\ntechnologies and use of strong cryptography as a mechanism for social\r\nbenefit.</p>\r\n\r\n<p><b>Our findings so far:</b></p>\r\n\r\n<ul>\r\n\r\n<li>The NSA contracted with Packet Forensics in 2012 for $500,000 and 2010 for $17,500. We will be appealing the NSA's redaction of what they purchased.</li>\r\n<li>The NSA contracted with French company Vupen for a year&apos;s subscription to their binary analysis and exploits service</li>\r\n<li>The NSA is not (yet) using the Netronome SSL interceptor, a piece of equipment highlighted in the WikiLeak&apos;s SpyFiles. Netronome was recently acquired by Blue Coat, a company for which we are currently waiting on FOIA results.</li></ul>\r\n\r\n<p><b>How you can help:</b></p>\r\n\r\nIf you haven't already, please create an account. Anyone can participate in this project by filing a FOIA for spy tech or contracts through MuckRock's website and tagging it with \"SpyLighter.\"<b>Please check the link</b> below for existing FOIA requests before filing one on a specific company to make sure it hasn't already been requested. Please also do a search for the company name in the search box to the right as some requests may not be tagged properly and we need to avoid duplicate requests.</p>\r\n<p><b>Tips on filing:</b></p>\r\n<p> \r\n<ul>\r\n\r\n<li>\r\nMake sure to include the full company name and address when seeking\r\ncompany contracts, otherwise your request may be rejected as not\r\nhaving enough information to complete the search. The FOIA office has\r\nin the past processed some of our requests as “key word” searches when\r\nwe had clearly requested a search with the company name. Include as\r\nmuch specific information about what you seek as possible.\r\n</li>\r\n\r\n<li>The language below was successful in obtaining the Vupen contract.\r\nThis can be a model for your request but please add the address of the\r\ncompany.</li>\r\n<blockquote>\r\n\"Copies of contracts with VUPEN Security and any final reports\r\ngenerated and delivered by VUPEN to the agency over the past 10 years.\r\nIf retrieving the contracts themselves is too burdensome please\r\nprovide a list of contracts.\"\r\n</blockquote>\r\n\r\n<li>Publicize your requests and responses! Tweet them out, tweet at us\r\nfor retweets, blog them, write about them!\r\n</li>\r\n\r\n<li>Ask for help if you get a denial or redaction. You can also search at\r\nMuckrock for how others have handled similar problems or submit a\r\nquestion here: https://www.muckrock.com/questions/\r\n</li>\r\n\r\n<li>Get inspired! We think asking for a list of invoices and\r\ntheir associated contract numbers may be a good idea. If successful it\r\nwill allow you to review and select contracts that look interesting for\r\nthe purposes of doing a separate FOIA request.</li>\r\n<li>As far as we're able to tell, NSA contract numbers all start with one\r\nof the following prefixes: MDA904, H98230-yy (where \"yy\" is the two\r\ndigit year, for example H98230-13-C) Prior to filing your request you\r\nmay want to search publicly available information for related contracts.\r\n</li>\r\n<li>From what we can tell, academic grants (usually focused around advanced mathematics/statistics) follow the format with a prefix of: H98230-yy-1</li>\r\n<li>The NSA apparently has a limited search capability that prevents them from doing keyword searches.  Heather attempted to obtain contracts on FinFisher software and received a response stating that by DoD regulation FOIA requests for contracts must contain a company name, contract number, or date.  She is appealing, but this keyword limitation is something to keep in mind when formulating your request.</li>\r\n<li>Again, please avoid submitting a request that has already been sent through the MuckRock website!</li>\r\n</ul>\r\n\r\n</p>",

States are scrambling to come up with new combinations of lethal drugs because [suppliers are refusing](https://www.nytimes.com/2016/05/14/us/pfizer-execution-drugs-lethal-injection.html?mcubz=0&_r=1/) to sell them drugs for lethal injections, or they’re looking to other methods of execution: Utah brought back [the firing squad](https://www.usnews.com/news/the-report/articles/2017-03-03/the-firing-squad-is-making-a-comeback-in-death-penalty-cases/).\r\n\r\n<iframe width=\"100%\" height=\"400\" seamless frameborder=\"0\" scrolling=\"no\" src=\"https://public.tableau.com/views/DeathPenaltyMethodsofExecution/Dashboard1?:showVizHome=no&:embed=true\"></iframe>\r\n\r\nEach execution with a new lethal injection cocktail is an experiment, and many of these experiments have already [gone wrong](https://news.vice.com/story/ohio-will-continue-using-drug-deployed-in-botched-executions/). Some states [won't say](https://www.theatlantic.com/national/archive/2014/01/the-secrecy-behind-the-drugs-used-to-carry-out-the-death-penalty/283348/) where the drugs they’re using for lethal injections are coming from, and some have admitted that they’re from compounding pharmacies, which do not have to go through the same regulation process as other drug manufacturers.\r\n\r\n<iframe width=\"100%\" height=\"371\" seamless frameborder=\"0\" scrolling=\"no\" src=\"https://docs.google.com/spreadsheets/d/e/2PACX-1vRmGX1yNDcPZnjJB5X1jUESRDQUHDHvUeU6BDFdUUIyn2-5CGtlzOcEA-gYp6CMYdTWI3hsuBjGGhXp/pubchart?oid=567104881&format=interactive\"></iframe>\r\n(Includes executions in the United States from 1890 to 2010. All of them. And you’re going to help.**\r\n\r\n<p>The Drone Census 2013-2014 is a joint initiative between <a href=\"http://motherboard.vice.com/blog/introducing-the-motherboard-muckrock-drone-census\">Motherboard</a> and MuckRock. Together, we’re uncovering precisely which government agencies across the country are using drones, the various purposes for which they're flown, and whether appropriate safeguards are in place to address privacy concerns.\r\n\r\n<p>MuckRock started the Drone Census last year in partnership with the <a href=\"eff.org/issues/surveillance-drones\">Electronic Frontier Foundation</a>. In our first round, we asked <a href=\"https://www.muckrock.com/drone-census-2012/\">more than 350 government agencies</a> across the country for details of their drone use, or lack thereof. With help from more than 100 tip submissions, MuckRock uncovered new details of the <a href=\"https://www.muckrock.com/news/archives/2012/oct/11/two-seattle-police-drones-sit-unused-department-se/\">Seattle drone scandal</a>, <a href=\"https://www.muckrock.com/news/archives/2013/mar/01/maine-state-police-toy-drone/\">Maine State Police's \"toy\" UAV purchase sans FAA oversight</a> and <a href=\"https://www.muckrock.com/news/archives/2013/jan/24/georgia-tech-police-wanted-fly-surveillance-drone-/\">Georgia Tech's grandiose plan to fly drones at football games</a>.\r\n\r\n<p>The second iteration of the Drone Census is bigger, more exhaustive and even higher-flying. We intend to (literally) write the book on domestic drones. Watch this space and the <a href=\"http://motherboard.vice.com/tag/the\\+drone\\+census\">Motherboard site</a> over the coming weeks for updates and analysis on who has drones, what they're doing with them and whether privacy concerns are being taken into account. But already, we've outlined the previously unknown <a href=\"http://motherboard.vice.com/blog/fbi-drone-program-documents\">history of the FBI's UAV program</a> (plus the Bureau's <a href=\"http://motherboard.vice.com/blog/the-fbi-doesnt-know-how-many-drones-it-has-or-whos-allowed-to-fly-them\">difficulty counting its drones</a>), found one drone <a href=\"http://motherboard.vice.com/blog/the-feds-have-no-idea-whos-flying-drones\">purchased by police in Brunswick, Ga.</a> with federal grants but sans FAA authorization, and <a href=\"http://motherboard.vice.com/blog/the-nypd-wants-to-fly-spy-drones-over-the-city-but-refuses-to-talk-about-it\">pressed NYPD for details</a> of its drone designs.             "description": "One of the findings that came in the aftermath of protests in Ferguson, MO was that the City of Ferguson was [increasingly funding its municipal operations with the use of fines](http://www.nytimes.com/interactive/2015/03/04/us/ferguson-police-racial-discrimination.html), including budgeting 23% of its FY2014 revenue from them.\r\n\r\nAs the New York Times reported, these fees included [$531 for high grass and weeds in a yard, $777 for resisting arrest and $792 for failure to comply with a police officer](http://www.nytimes.com/interactive/2015/03/04/us/ferguson-police-racial-discrimination.html).\r\n\r\n![](https://muckrock.s3.amazonaws.com/news_photos/fines.png)\r\n\r\nWith this project, you can help fund a national look at just where and how fines are used to fund everyday government operations, and help shed light on how many agencies are using fines as a backdoor way to tax their citizens with little oversight, scrutiny, or public participation.\r\n\r\nWe will be requesting five years with of data on how fines are collected from as many agencies as we can, and then working to analyze the results. The requests will all be filed publicly, so you can follow along on our progress.\r\n\r\nWe'll be requesting the following information from agencies:\r\n\r\n* A copy of any official calculations of revenue coming from court fees and fines between FY 11 and FY 15, or calendar year 2010 and calendar 2014 if your government operates on a calendar year budget cycle. \r\n\r\n* Accounts Receivable databases that cover fines and fees paid for government services by individuals, rather than businesses. This would include Revenue Journals that cover such payments, as well as other financial statements that cover income from fees and fines.\r\n\r\n* Any logs of appeals of fines that is kept by this agency, including, if the log has it, outcome of the appeal, payments made, and other fields that are present in such a log.\r\n\r\n* A copy of contracts with any vendors that help manage the assignment, collection, or management of fees and citation information. This would include contracts with vendors that provide parking ticket software, for example, as well as court fees.\r\n\r\n* The record layout for any databases that are used to track the assignment, collection, or management of fees, fines and citations.             "description": "Through the last year and a half, we have used FOIA to investigate the use of surveillance equipment by the Chicago Police Department (CPD). Through [multiple FOIA requests and lawsuits](http://arstechnica.com/tech-policy/2014/09/after-small-victory-in-stingray-case-chicago-man-seeks-more-records/), we have demonstrated the CPD's purchase and [use of controversial \"Stingray\" cellphone surveillance devices](http://arstechnica.com/tech-policy/2014/06/is-chicago-using-cell-tracking-devices-one-man-tries-to-find-out) among other new surveillance technologies. Also through this work we have seen [Chicago Police acting in \"bad faith\"](http://shadowproof.com/2014/06/10/chicago-police-sued-for-acting-in-bad-faith-by-failing-to-provide-stingray-surveillance-records/) in fulfilling our FOIA requests.\r\n\r\nFurther investigation demonstrated that money to purchase this surveillance gear was originating from their \"1505\" Narcotics asset forfeiture fund. In some cases these funds are seized from citizens only suspected of criminal wrongdoing - citizens not convicted in court.  In this project we aim to understand how these funds are spent by conducting an independent audit of the CPD's 1505 Narcotics asset fund. We are requesting documents to find out what each check in the fund greater than $5000 was spent on.\r\n\r\nOur investigations of the 1505 fund thus far have revealed the purchase of a [\"Hailstorm upgrade\"](https://github.com/lucyparsons/1505-documents/blob/master/IMSI%20Catchers%20(Checks%20unknown)/CPD_FOIA14-5298%20Response.PDF) to CPD's Stingray in order to enable surveillance of 4G LTE cellphones. The use of this equipment has come under intense scrutiny because the authorization may be coming from pen/trap orders which may conflict directly with IL state legislation that protects citizens from unlawful location surveillance - IL SB-2808 (see [here](http://www.loevy.com/wp-content/uploads/2014/09/Freddy-Martinez-v.-Chicago-Police-Department2.pdf), [here](http://www.ilga.gov/legislation/BillStatus.asp?GA=98&DocTypeID=SB&DocNum=2808&GAID=12&SessionID=85&LegID=78729) and [here](https://www.vice.com/read/stingrays-and-secrets-how-the-chicago-police-department-was-forced-to-come-clean-330)). We have found that these funds are also being used for the purchase of [PENLink surveillance software](https://github.com/lucyparsons/1505-documents/blob/master/2014/%23177699%20PenLink/PenLink%20QUO-04689-V8Y5D0Redacted.pdf) and Cellbrite cell phone forensics software by the [Cook County Sheriff's Office (CCSO)](https://github.com/lucyparsons/1505-documents/blob/master/CookCountySherr_Cellbrite_Redacted.pdf) and [CPD](https://github.com/lucyparsons/1505-documents/blob/master/CelleBriteFOIA15-3895.pdf).\r\n\r\nRecently in Chicago, we've seen [Chicago Police spying on Black Lives Matter activists](https://privacysos.org/node/1819), potentially even using some of these new surveillance tools. Investigations like this audit are important for bringing transparency and accountability to the use of new surveillance devices by law enforcement. Electronic surveillance devices should have strict policies to regulate their use to prevent inappropriate use of new technologies, such as monitoring political protests. That accountability discussion can only occur if citizens are aware of the tools that local law enforcement are using. However, Chicago Police have spent [hundreds of thousands of dollars](http://arstechnica.com/tech-policy/2015/04/chicago-owes-lawyers-over-120000-for-defense-against-two-stingray-cases/) to maintain secrecy around their surveillance devices by fighting citizens trying to get access to public records through FOIA.\r\n\r\n**We need your help to find out what else the 1505 funds are being used to purchase.** To date we have requested about 25% of the 2014 funds ([link to mirrors](https://github.com/lucyparsons/1505-documents/)) and have another 25% of 2015 FOIAed.             "summary": "The federal government and most states offer up a smorgasbord of tax credits, or tax incentives, to companies and nonprofits. These tax breaks encourage research, construction, job creation, historic preservation, and many other valuable goals. They can range in size from several thousands  to tens of millions of dollars. But oftentimes, the organization that receives a tax credit has no use for it. This can happen when the value of the credit exceeds a company's tax liability or when the credit is given to a nonprofit that isn't taxed anyway. This has created a burgeoning marketplace for tax breaks, and the main purchasers are Fortune 500 companies. Many states shroud the sale of tax credits in secrecy -- we don't know whether a tax credit granted for the preservation of a historic post office is actually being used by Google or the governor's best friend, and we don't know what they traded to get it. Let's find out.",
            "description": "Most states have tax confidentiality laws that prevent any government official from disclosing tax information. This makes it hard to get records of who’s selling tax credits and who’s buying them. There are a few cracks in the black boxes — some state confidentiality laws have exemptions related to tax credits — but the best strategy I’ve come across so far is targeting tax credit transfer notices that are sent anywhere besides a state’s department of revenue. In Georgia, Louisiana, and Orgeon, for example, these notices are sent to agencies like the department of economic/community development or department of energy.  Google a state and “tax credit transfer” and you’ll usually get a user manual for how to transfer a credit and where to file the paperwork.             "description": "**Who can make a FOIA request?**\r\n\r\nGenerally any person – **United States citizen or not** – can make a FOIA request.\r\n\r\n**Introduction**\r\n\r\nOnly a few small pieces were recovered, all in completely random occurrences that could have happened to anyone.\r\n\r\nMoreover, not honest, wrong, and not morally right for respect of the families of the missing passengers, statements have been made promising that the plane would have been found in the next few weeks, or by the end of the year. It didn’t happen.\r\n\r\nThe search has a projected total cost of $160M of the Australian Federal Budget. In Australia there is a lot of public opinion unhappiness due to the possibly, ending without any result, in June 2016 that has costed public money.\r\n\r\nAt the same time calling off the searches without any result, will have a negative impact on  the trust from public and perhaps even on the opinion of aviation safety.\r\n\r\nThe story of the last two years is full of edited documents, contradicted and denial of official statements by other official sources. What was presented as “advanced calculations” by Inmarsat quickly changed its presented intrinsic meaning to “pure truth” of the final location. Probably it is not, since MH370 has still not been found after two years, $160M spent and multiple “refinements” of the search zones.\r\n\r\nIt’s not a matter of when but if, I think the commitment to find MH370 should continue, perhaps not in the same search zone. What we have faced with is something that has been completely different in multiple ways from other plane crashes/disappearances and that was abundantly debated. Exact causes must be examined, countermeasures must be taken to make such an event never happen again.\r\n\r\n**Planes don’t disappear, leaving a few small pieces on the opposite side of the world.**",

W. Bush.\r\n\r\n* **Clair George** - CIA officer in the clandestine service who oversaw all global espionage activities for the agency in the mid-1980s.\r\n\r\n* **Donald Gregg** - worked for the Central Intelligence Agency for 31 years. He was a National Security Council advisor (1979–1982) and National Security Advisor to U.S. Vice President George H. W. Bush (1982–1989).\r\n\r\n* **Albert Hakim** - Iranian-American businessman and a figure in the Iran-Contra affair who participated in an aerial reconnaissance program run by CIA and Imperial Iranian Air Force from bases inside Iran against the Soviet Union.\r\n\r\n* **M. Charles Hill** - Senior adviser to George Shultz, Henry Kissinger, and President Reagan, as well as Boutros Boutros-Ghali, the sixth Secretary-General of the United Nations.\r\n\r\n* **Edwin Meese III** - Served within the Reagan Presidential Transition Team and the Reagan White House, eventually rising to hold the position of Attorney General, from which he resigned while under investigation from a special prosecutor.\r\n\r\n* **Robert McFarlane** - National Security Advisor to President Reagan\r\n\r\n* **Richard Miller** - Communications consultant who helped raise money for the Nicaraguan rebels and plead guilty to a conspiracy to defraud the U.S.\r\n\r\n* **Oliver North** - National Security Council staff member alleged by John Kerry to have created a privatized Contra network that attracted drug traffickers looking for cover for their operations, then turned a blind eye to repeated reports of drug smuggling related to the Contras, and actively worked with known drug smugglers such as Panamanian dictator Manuel Noriega to assist the Contras.\r\n\r\n* **Nicholas Platt** - American diplomat to Pakistan, Philippines, Zambia, and as a high level diplomat in Canada, China, Hong Kong, and Japan.\r\n\r\n* **John Poindexter** - Deputy National Security Advisor and National Security Advisor for President Reagan, convinced of multiple felonies as a result of Iran-Contra.\r\n\r\n* **Ronald Reagan** - President of the United States\r\n\r\n* **Donald Regan** - President Reagan's Secretary of the Treasury and White House Chief of Staff\r\n\r\n* **Richard Secord** - Took part in CIA's secret war in Laos, involved in Iran-Contra and one of its precursors, Operation Tipped Kettle.\r\n\r\n* **George Shultz** - President Reagan's Secretary of State, known for opposition to the Iran-Contra  scandal.\r\n\r\n* **Paul Thompson** - Navy commander who was detailed to the National Security Council staff, military assistant to National Security Adviser Robert C. McFarlane.\r\n\r\n* **Caspar Weinberger** - President Reagan's Secretary of Defense, claimed to be opposed to the sale but participated in the transfer of United States Hawk and TOW missiles to Iran during the Iran–Contra affair. He was pardoned by President George H. W. Bush, who was Reagan's vice president during the scandal.",

            "description": "To justify censorship of artwork critical of President Trump Polk State College administrators claimed the art would upset high school students who might see it and that display of the artistic work could be criminally prosecuted as obscene for violating the Miller standard, a standard which contains an exception for artistic works and political commentary. Usually this involves drugs or guns, but it can extend to assets such as cars, yachts, and houses.\r\n\r\nThe burden of proof usually lies on the owner, who must demonstrate that their money or goods are not crime-related in order to avoid forfeiture. If the property is forfeited, its value is split between the law enforcement and prosecutorial agencies involved in the seizure and a general fund for either the state or federal government.\r\n\r\nAsset forfeiture is therefore a valuable cash cow for money-hungry law enforcement agencies.             "description": "**THE COST OF A CALL**\r\n\r\nIn the digital age, the price to call countries continents away can be practically nothing, but the incarcerated can be hit with prices per minute up to $15. Where are the additional costs coming from? Most agree that to blame are the fees imposed by Inmate Calling Services (ICS) - for maintenance and for profit - and encouraged by prison administration, which often receives a cut of each phone cost.\r\n\r\n**THE RIGHT TO A PHONE CALL**\r\n\r\nIn most states, your ability to place phone calls is not guaranteed. It can be expensive to install and maintain a phone system, so private phone companies have filled the need by providing a plan with perks for the prisons themselves, too. Securus, the largest ICS provider in the nation, for example, will provide equipment, installation, and regular maintenance at no cost to the facility. To recoup these costs, they add fees to the costs paid by inmates to place the phone calls, and to make the deal appealing to administrators, they tack on further fees as a commission for the prison or jail itself.\r\n\r\n**REGULATIONS**\r\n\r\nThe Federal Communications Commission tried to step in during the Obama administration to cap the costs of both interstate (from one state to another) and intrastate (within one state) prison phone calls. ICS providers challenged the intrastate regulations, based on the federal agency’s ability to place trade restrictions across state lines but not within them, and a court recently agreed. This means that monitoring and limiting the costs in-state phone calls will be left to state-specific regulatory agencies - if they take up the task.\r\n\r\n**COMMISSIONS**\r\n\r\nThe cuts received by jailers themselves are the most controversial elements of the current prison phone system. Administrators see the funds as a useful supplement to operating costs; the families of the incarcerated feel them as another they’re being gouged, almost irredeemably, by the justice system.
