Pursuant to the South Carolina Freedom of Information Act, I hereby request the following records:

All documents relating to usage of Automated License Plate Recognition (ALPR) technology by the Darlington County Sheriff's Office, including but not limited to documents indicating:

-scope of ALPR deployment;
-purposes for which ALPR technology is employed;
-means of handling and storing ALPR data;
-extent and timeline for ALPR data storage; and
-protocols and extent of ALPR data sharing between DCSO and other government agencies.

Please include any relevant documents, including but not limited to memos, reports, emails, meeting minutes and contracts.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 15 business days, as the statute requires.

Dear Sir,

Darlington County Sheriff's Office currently uses two ALPR systems. The systems where purchased last November and where installed and brought online in January of this year. The systems are used for law enforcement only. The data is stored, and shared with servers at the State Law Enforcement Division in Columbia, S.C. The Darlington County Sheriff’s Office does not store any data on site. Records for the purchase and memoranda of understanding are available for your review during regular business hours at the Darlington County Sheriff’s Office located at 1621 Harry Byrd Hwy Darlington SC 29532

Hello, I am receipt of your FOI that was previously sent to Andy, I have
been assigned to replace Andy and hope that I can provide the information
for you. I am not very familiar with the system but spoke with the
operators. The system we have has been down and not working for several
weeks, ALPR has been contacted via e-mail and phone with no reply. The
information on these devices are stored within ALPR and they share the
information with SLED. SLED is the state wide coordinator for the system
for what I understand. For us to retrieve the information we go through
SLED or ALPR web. The units when working are used during patrol and we have
two of them. The information that is looked at is fugitive, vehicle tag
violations, stolen or felony vehicle. I hope that this helps and I
apologize for the delay, if you have anything else that is needed please
contact me via e-mail and I will try to answer.

Thank you for your response.

Since the data is stored and maintained by SLED, its retention would fall under their policy (which I have). Are there any policies, general orders, etc. surrounding the appropriate use of the data, auditing that use, or the handling and penalties for violations at the Darlington CSO?

Also, I don't necessarily need a copy of all the paperwork, but could you tell me how much the two devices cost, where they were purchased from, and how they were paid for (grant vs. public funds)?

Chris, I am in receipt of your additional request and for some reason it is
being routed to Denise Windham that handles press releases and should be
routed to me for FOI, if you could make that change as I have provided for
you below. I am new to this as well but from what I understand Capt. Street
was in the process of writing a policy along with others, and the
individuals that used the system operated under SLED guidance and the
information was if I understand correctly is shared with the parent company
and SLED. The two units were purchased from NDRIS at a cost of $28,974.00.
the penalities for misuse would be same as any other violation which could
include written reprimand, suspension without pay, loss of rank and or
termination. Hope this helps but in the future please reply to the e-mail
listed below.
