Pursuant to Virginia Freedom of Information Act, I am requesting access to electronic copies of the number of all unprocessed PERK Kits aka Rape kits in Virginia . In other words, all Perk kits in the Commonwealth that have yet to test for DNA evidence. Please also include the name or agencies or jurisdictions that have not yet submitted PERK Kits information. Per a bill signed into law by Governor McAuliffe, the Physical Evidence Recovery Kit (PERK) Inventory is mandated by Senate Bill 658. The inventory deadline was set for February 1.

If my request is denied in whole or part, I ask that you justify all deletions by reference to specific exemptions of the act.

I would be grateful if you would inform me of the total charges (and calculation method) in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

The Virginia Department of Forensic Science (DFS or the Department) has received your request, submitted March 11, 2015, under the Virginia Freedom of Information Act (FOIA) for “the number of all unprocessed PERK Kits aka Rape kits in Virginia,” as well as the “name or agencies or jurisdictions that have not yet submitted PERK Kits information.” As we discussed today by telephone, your request for “the number of all unprocessed PERK Kits aka Rape kits in Virginia” would include the number of Physical Evidence Recovery Kits (PERKs) that have been submitted for and are awaiting testing at the Department of Forensic Science, as well as those PERK kits that were not submitted for testing and are the subject of the inventory required under SB 658. In our conversation today, you indicated that your intent was to request information to date for the Physical Evidence Recovery Kit (PERK) inventory currently underway pursuant to Senate Bill 658.

As of 3:00 p.m. today (March 18, 2015), the total number of PERK kits reported is 2,360. Those criminal justice agencies that have not yet responded to the inventory are listed below.

Please note that the Department anticipates that additional responses will be received. While the Department set a deadline of February 1, 2015 for law enforcement agencies to submit their inventories, DFS is continuing to receive inventories and the number of PERK kits may continue to change. The Department anticipates that between now and July 1, 2015, we will be requesting and receiving additional responses from the agencies above, and we will be seeking additional information from many of the agencies that have already responded. The complete results of the inventory which will include information in addition to the number of kits, will be reported to the General Assembly by July 1, 2015.
