To Whom It May Concern:

Pursuant to RCW Ch. 42.56 (Public Records Act), I hereby request the following records:

The log of public records requests received by Seattle Police Department, current status and resolution of those requests. If this record exists in electronic format, I request receipt of it as such, not a scan of a printed copy of the record.

I also request that, if possible, fees be waived as I believe this request is in the public interest and not made for commercial gain. The requested documents will be processed by a representative of the news media/press and made available to the public at MuckRock.com. Please fulfill the request electronically, by e-mail attachment if possible or CD-ROM if not, and let me know of any fees that will be assessed.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

This letter is in response to your public disclosure request dated September 29, 2011 and received by the Seattle Police Department on September 29, 2011 for the Public Disclosure Log.

Pursuant to RCW 42.56.520, this is notification that we have received your public disclosure request, and we anticipate it may take up to 8 weeks from the date of this notification to respond. Therefore we anticipate a response to you on or about December 5, 2011.

This additional time is used to research this request, collect responsive records, and/or prepare records for dissemination. Please note: Seattle Police Department currently receives approximately 5,000 public disclosure requests annually. The current volume of Public Disclosure Requests combined with SPD staffing and City-wide budget cuts requires this additional time.

The Department has interpreted your request to be for the following items regarding our public disclosure requests: public disclosure request #, Date Received and Date resolved for the year 2011, since you did not specify a time frame. If there is not a date entered into the "date resolved" column, that means that the request is still open/not completed yet. Please see attached responsive record. If the Department has interpreted your request incorrectly, please clarify your request.

You may file a written appeal of this response with the Chief of Police within ten (10) business days from the date of this letter. Please include your name and address and a copy of this letter together with a brief statement identifying the basis of the appeal. Please mail or deliver your appeal to:

On December 5, 2011, Sheila Friend Gray at Seattle Police Department wrote, "The Department has interpreted your request to be for the following items regarding our public disclosure requests: public disclosure request #, Date Received and Date resolved for the year 2011. [...] If the Department has interpreted your request incorrectly, please clarify your request."

On September 23, 2011, at 11:46 a.m., I asked via e-mail, "Does SPD keep a log of public records requests received, current status, resolution, etc.?" On September 29, 2011, at 10:24 a.m., Tricia Colin at SPD replied via e-mail, "Yes, SPD does keep a log of public records requests received, current status, resolution, etc."

I reiterate my request for that record. I did not ask for a record to be created, or for access to a subset of a record. Please do not interpret my request to be a request for anything less than the entire log to which Ms. Colin referred.
