Pursuant to the Massachusetts Public Records Law, M.G.L. c.66, §10, I hereby request the following records:

All communication concerning the schedule, updating, funding & construction of the City of Boston "Bicycle Master Plan".

I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

I expect the request to be filled in an accessible format, including for screen readers, which provide text-to-speech for persons unable to read print. Files that are not accessible to screen readers include, for example, .pdf image files as well as physical documents.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

The Law Department is in receipt of your public records request for "all
communication concerning the schedule, updating, funding & construction of
the City of Boston 'Bicycle Master Plan.'"

The City has initially determined that appropriate custodians of such
documents might be Kristopher Carter, Alice Brown, Nicole Freedman, Thomas
Tinlin, and Michael Kinneavy, and that appropriate search terms within
those custodians' documents might be Toole Design Group, Laurie Pessah,
Pete Robie, Nick Jackson, Boston Bikes Network Plan, and Boston Bikes
Master Plan.

We are assuming that you are referring to communications while the City was
in the process of developing the Boston Bikes Network Plan released in 2013.

Can you please review this list of custodians and search terms and
determine whether you want to add to these options or remove any of these
options? Can you please let us know if our reading of your request is
correct, or if you want a larger scope that includes projects that have
since been developed in keeping with the Plan and where the Plan might have
been referred to in emails (this will be a very large set of documents)?
We would also request that you provide us with a date range that you want
searched.

Once we know the number of documents that are identified as a result of
your search terms, we will be able to provide you with a fee estimate for
our review and redaction of your request.

I would like to limit the time frame in which the search is conducted to January 1, 2015 to the present.
In addition to the criteria referenced in your email, I would like to add Katie Choe and Para Jayasinghe as people whose communications should be searched. I am particularly interested in the development (or lack thereof) of the bicycle master plan in the referenced time frame.

Hi Jonathan,

Initially, we did two searches:

1) Dates: January 1, 2015 to present
Custodians: Kristopher Carter, Alice Brown, Nicole Freedman, Thomas Tinlin,
and Michael Kinneavy, Katie Choe, and Para Jayasinghe
Terms: Toole Design Group, Laurie Pessah, Pete Robie, Nick Jackson, Boston
Bikes Network Plan, Boston Bikes Master Plan

2) The same search as above, but adding as terms: "Network Plan" and
"Master Plan."

Search #1 resulted in 2,126 results and Search #2 resulted in 3,333 results.

Because these would result in a high fee assessment under the records law
(Search #1 - $835.83; Search #2 - $1,338.75) and likely include a large
number of non-responsive documents, I spoke to BTD employees to see if we
could come up with a search that isolated relevant documents better.

3) Dates: January 1, 2015 to present
Custodians: Kristopher Carter, Alice Brown, Nicole Freedman, Thomas Tinlin,
and Michael Kinneavy, Katie Choe, and Para Jayasinghe
Terms: ("network plan" AND (bike OR bicycle)) OR ("master plan" AND
(bicycle OR bike))

This resulted in 588 results. The fee assessment under the records law for
this request would be $195.

Please let us know if you would like the City to fulfill any of these three
requests or would like to restrict your request further. Upon receipt of a
check from you, the City would then proceed to review the documents for
responsiveness to your request, potential exemptions from the Public
Records Law, and privilege. The City would provide a detailed accounting
of any documents withheld from production.
